General condition of sale

The present general terms and conditions of sale (hereinafter referred to as the "General Terms and Conditions") govern the sale of products offered by Akal Food, a simplified joint stock company with variable capital of €42,000, whose registered office is located at Ferme de Bouquetot, chemin des Broches, 14950 Saint-Pierre-Azif, registered in the Lisieux Trade and Companies Register under number 813 144 581, via the website https://akalfood.com (hereinafter referred to as the "Site").

Article 1 - Definitions

"Buyer": means any natural person of full age with the capacity to contract or any legal entity wishing to purchase one or more Products offered by Akal Food via the Site. "Order": means the Buyer's willingness to legally accept the offer of Products marketed by Akal Food on the Site. "Product" or "Products": refers to all of the products that Akal Food offers to the Buyer on the Site.

Article 2 - Purpose

These General Conditions aim to define the contractual relationship between Akal Food and the Buyer and the conditions applicable to any purchase made through the Site, whether the Buyer is a professional or a consumer. The Product Order is reserved to the Buyers having accepted without reserve the present General Conditions in their entirety, prior to their Order; any Order implies the full and entire acceptance of the present General Conditions. Akal Food reserves the right to modify the present General Terms and Conditions at any time and without prior notice. Consequently, the applicable General Terms and Conditions are those in force on the Site on the date the Order is placed. These General Terms and Conditions will prevail over any other general or special terms and conditions of sale or purchase not expressly accepted by Akal Food.

Article 3 - Order

To finalize an Order, the Buyer must fill in all the mandatory fields of the registration form and undertakes to provide Akal Food with accurate, complete and up-to-date information. The Customer certifies that the information communicated to Akal Food is accurate on the day the order is placed and that he is authorized to place the order. The Buyer is able to place an order without creating a customer account if he wishes to do so, simply do not check the "Create an account" box when entering his information. The Customer ensures in particular the proper functioning of the said e-mail address. Indeed, Akal Food cannot be held responsible for malfunctions of the e-mail address recorded by the Customer, in particular a typing error by the Customer, e-mail treated as spam/undesirable, etc. Akal Food cannot be held responsible for any error in the case of erroneous information that does not allow delivery of the Products. If the Customer loses his or her password, he or she can click on the "Forgotten password" link to automatically receive his or her password by e-mail. This password is in no way used to make any payment whatsoever.

Article 4 - Consent

Consent is expressed when the Customer has confirmed his order. Any order placed on the Site by the Customer and confirmed by Akal Food by e-mail will be binding on the Customer as irrefutable and complete proof of this order and as confirmation of the Customer's acceptance of the application of these General Terms and Conditions of Sale. In general, it is expressly agreed between Akal Food and the Customer that the e-mails will be considered as proof between the parties as well as the automatic registration systems used on the Site, in particular with regard to the nature and date of the order.

Article 5 - Terms of Payment

Payment of the price is due at the time of the order. The payment of orders is made: by credit card via PayPal or by e-transaction, the banking interface of the Crédit Agricole. by check.

Article 6 - Price and payment

incident a) Price The applicable prices are those mentioned on the day the Order is recorded. The prices indicated are expressed in euros, all taxes included (TTC). b) Payment incident In the event of a payment incident, Akal Food informs the Customer by e-mail and proposes another means of payment. Payment is then made within a maximum of seven (7) working days from the date of sending the e-mail.

Article 7 - Right and period of retraction

The Customer benefits from a right of retraction provided that the packaging of the Product Ordered is intact. The Customer may exercise this right by returning all or part of the Products Ordered to Akal Food's head office at his own expense within fourteen (14) clear days from the delivery of the Products. In the event of exercising the right of retraction within the above-mentioned time limit and conditions, the Customer may, at his choice, exchange the Product Ordered, benefit from a credit note or be reimbursed. Reimbursement shall be made in the same payment method within thirty (30) days following the date on which the right was exercised.

Article 8 - Deliveries

The order is processed by Akal Food within two working days following the validation of the payment (excluding vacations), then sent by Colissimo. In general, the order is thus received, in France, within 3 to 5 working days after payment. Akal Food is not responsible for any delays added by the Post Office. In case of non-receipt according to the Customer's statements, no refund or return of products will be made by Akal Food if the package has been declared delivered in due form by the Post Office. Each Customer automatically receives e-mails from Akal Food and then from La Poste allowing him to follow the processing of his order and the delivery of the package. It is up to the Customer to check in the Undesirable file of his mailbox if necessary. In case of return of the package to Akal Food (example: incomplete delivery address, package not picked up by the Customer...), Akal Food will refund the amount of the order minus the shipping costs. It will be up to the Customer to reorder. Shipping costs are calculated according to the weight of the order and are indicated on the order confirmation and on the invoice. Delivery is free of charge for orders over 65€, in metropolitan France only.

Article 9 - Warranty and Liability

9.1 Product Conformity At the time of delivery of the order, the Customer must ensure that the Products conform to his order and that the Products are in good condition. From the time of delivery, the Customer is responsible for the storage conditions of the Products. 9.2 Force majeure The Seller's obligations shall be suspended by operation of law, without compensation to the Customer, in the event of the occurrence of events of force majeure such as, in particular, war, riots, labor unrest, flooding, fire, bad weather, lightning, epidemics, general breakdown of electrical or computer systems. The Customer acknowledges that breakdowns and technical problems concerning hardware, computer programs and software or the Internet network, which are not limited to interruptions, suspensions or closures of the Site, constitute a fortuitous event resulting in the suspension of the vendor's obligations. It acknowledges, therefore, that the Vendor cannot be held liable for damages related to these problems.

Article 10 - Protection of personal data

When registering for the first time on the Site, the Customer fills out an electronic information form with mandatory fields (in particular: surname, first name, company name, geographical and e-mail addresses, telephone numbers) as well as optional fields. Akal Food takes care to protect all data entrusted by the Customer for the processing of the Order. This data is intended solely for Akal Food for the purposes of order management and for business relations with Akal Food. In accordance with the French law no. 78-17 of January 6, 1978 relating to data processing, data files and individual liberties, the Customer has the right to access, consult, modify, rectify and delete data communicated by him/her to Akal Food. Article 11 - Non-compliance with these general terms and conditions of use

In the event of non-compliance with these general terms and conditions of sale, Akal Food reserves the right to prohibit the Customer from accessing the Site and its Products without being able to claim any compensation whatsoever. The fact that Akal Food has not removed the Customer's access to the Site does not relieve the Customer of this responsibility.

Article 12 - Jurisdiction

Any dispute relating to the interpretation and execution of the present terms and conditions will be subject to French law. The dispute thus raised will be submitted to the competent jurisdiction, after an unsuccessful attempt at amicable settlement between the parties.
